Case Overview:
Police were dispatched to a man’s home for an outstanding arrest warrant for violating his pretrial conditions for a pending drug trafficking case he had in Bristol County Superior Court. The man, who had a lengthy criminal history comprised of a variety of violent, drug, and theft related offenses, was searched for weapons, placed into handcuffs, and transported to the Fall River Police Station for booking. While conducting a periodic check of the man in a holding cell, police noticed he was slumped over, his eyes were closed, and he was unresponsive when they knocked on his cell. Upon entering the cell, police discovered in the man’s hand 2 grams of crack-cocaine, approximately 1 gram of cocaine, 35 suboxone strips, and 5 clonazepam pills. All of these items were individually wrapped and smelled of feces. The man was transported to the hospital for an evaluation and was ultimately charged in Fall River District Court with 2 counts of Possession of a Class B Drug, both subsequent offenses, and Possession of a Class C Drug, subsequent offense. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, Inc. to represent him in his case.
Case Result: Dismissed.
After reviewing and analyzing all the evidence in the case, and following ongoing negotiations with the Commonwealth, Calcagni and his team successfully secured the Commonwealth’s agreement to dismiss this case.
