Woman charged in the Bristol County; Fall River District Court for:
- Assault and Battery – M.G.L. c. 265, § 13A (a)
Case Overview:
Police were dispatched to a three-story family home where a physical altercation had just occurred between a woman and her neighbor in the driveway. Upon arrival, police spoke to the woman, who informed them that while she was getting ready to go to the gym, from inside her apartment, she could hear her neighbor outside of her door complaining about parking, blaming her for the parking issue and insulting her. When the woman opened the door, the two began to argue, and the neighbor told her, “Let’s take this outside.” The two proceeded outside, the neighbor smacked the woman in the face, and the two began to fight each other. The incident was caught on video by another neighbor and provided to police as evidence. The neighbor was charged with Assault and Battery and received a summons to appear for a Clerk-Magistrate’s Hearing in Fall River District Court. She appeared for this hearing without a lawyer and a criminal complaint issued against her. She then received a summons to appear for arraignment in Fall River District Court to answer on the charge of Assault and Battery and retained Massachusetts Criminal Defense Attorney John L. Calcagni and his team to represent her in her case.
Case Result: Filed Without a Charge of Plea for One Year.
After reviewing and analyzing all the evidence and following ongoing negotiations with the Commonwealth, Calcagni and his team successfully secured the Commonwealth’s agreement to file this matter without a change of plea for one year. Once before the Court, the judge adopted this recommendation and sentenced the neighbor accordingly. Assuming the neighbor remains out of trouble for one year, her case will be dismissed at that time, and she will be immediately eligible to seal it off her Massachusetts criminal record.
