Fentanyl Charge Dismissed, Probation Secured in Worcester Superior Court

Case Overview:

Police investigated a Rhode Island man who was engaging in the illegal distribution of drugs from his motor vehicle.  They obtained his phone number from a confidential informant, and over the course of several weeks, conducted ten undercover hand-to-hand transactions of several grams of cocaine and counterfeit oxycodone pills containing fentanyl.  During the final transaction, police arrested the man and seized from him 400 counterfeit oxycodone pills containing fentanyl.  Following his arrest, he immediately hired Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him before the Uxbridge District Court.  

Case Result: 2 Years of Probation.

Attorney Calcagni and his team immediately worked to secure the man’s release on bail.  They then shifted the focus of their efforts to defending the man in Worcester County Superior Court following his indictment with 2 counts of Distribution of Cocaine and one count of Trafficking in Fentanyl, 36 – 100 Grams, which carries a mandatory minimum 5-year state prison sentence.  After reviewing and analyzing all the evidence and uncovering misconduct by police related to the illegal recording of the controlled drug buys by the undercover officer, Attorney Calcagni and his team successfully persuaded the prosecution to dismiss the Trafficking in Fentanyl charge, thereby eliminating the client’s exposure to mandatory jail.  Attorney Calcagni and his team then drafted and submitted a comprehensive sentencing memorandum for the Court to consider in support of a non-jail request to resolve the two remaining Distribution of Cocaine charges.  The prosecution advocated for a term to serve in the House of Corrections.  Following the judge’s consideration of the memorandum, and oral advocacy in support of the Defense sentencing recommendation, Attorney Calcagni and his team successfully persuaded the judge to place the man on probation for two years.
