Criminal Charges:
Man charged in the Fall River District Court, Bristol County, Massachusetts for:
- Trafficking in 36 – 100 Grams of Fentanyl, in violation of M.G.L. c. 94C, § 32E(c)
- Possession of Ammunition without an FID Card, in violation of M.G.L. c. 269, § 10(h)(1)
Case Overview:
A man with a lengthy criminal record and an open drug trafficking case in Rhode Island accidentally discharged an unlicensed and unregistered firearm in his home. His girlfriend was present at the time. She informed her family of what happened. Her mother reported it to police. Police were dispatched to the residence and located the man nearby. He attempted to flee but was apprehended. Police obtained and executed a search warrant at his residence where they located the bullet hole, 41 rounds of ammunition, 31 grams of Fentanyl, an additional 1,894 bags of Fentanyl, 9 caplets of Oxycodone, 9 Percocet tablets, 17 Alprazolam pills, 30 Clonazepam pills, a digital scale, and $15,000 in cash. Based on these facts, the man was indicted in Bristol County Superior Court with both Fentanyl Trafficking and Possession of Ammunition without an FID Card. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in his case.
Case Result: Bail Granted.
The Commonwealth moved to hold the man without bail on grounds of dangerousness. The Defense opposed the motion and petitioned the Court for the man’s release on bail. After the hearing, the Court ordered the man’s release, over the Commonwealth’s objection, on $20,000 cash bail with various conditions.
