Case Overview:
A young man, in the process of enlisting in the U.S. Air Force, was accused by a former high school girlfriend of non-consensual intercourse during a brief dating relationship. Shortly after their breakup, the young woman obtained a Harassment Prevention Order, which was extended for one year. Months later, she alleged the young man violated the order by appearing at a local park where she was watching a lacrosse game and making eye contact with her. Franklin Police filed an application for a criminal complaint alleging Violation of a Harassment Prevention Order. The young man received a summons for a Clerk-Magistrate’s Hearing in Wrentham District Court and retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him.
Following the Clerk-Magistrate’s preliminary remarks, the police prosecutor’s statement, and oral arguments by Attorney Calcagni’s team, the Clerk-Magistrate denied the application for criminal complaint. This outcome preserved the young man’s clean record and protected his future military career.
