Criminal Charge:
Man charged in the Taunton District Court, Bristol County, for:
- Indecent Assault and Battery on a Child Under 14, in violation of M.G.L. c. 265, § 13B
Case Overview:
Disclosures of sexual abuse were made by a 12-year-old child alleging that her paternal grandfather touched her inappropriately in the past. The allegations surfaced when a poem authored by the child was brought to a school counselor’s attention. The child’s mother was contacted and interviewed by the Department of Children and Families where she described numerous odd behaviors by the grandfather toward her daughter. A criminal complaint was then issued against the grandfather for Indecent Assault and Battery on a Child Under 14 in Taunton District Court. He retained Massachusetts Sex Assault Defense Lawyer, John L. Calcagni III, and his team to defend him in his case.
Case Result: Amended to Misdemeanor Assault and Battery with Probation.
After reviewing the evidence and litigating several motions, Attorney Calcagni and his team successfully negotiated a pretrial resolution of this case whereby the prosecution agreed to amend the sex crime of Indecent Assault and Battery on Child Under 14 (a felony offense that requires sex offender registration) to the non-sex crime of Assault and Battery, in violation of M.G.L. c. 265, § 13A (a misdemeanor offense that requires no sex offender registration). In exchange for the man’s admission of guilt to this amended charge, he was placed on probation for one year with the condition that he stay away from and have no contact with his granddaughter.
