Shoplifting Charge Avoided at Wrentham District Court

Case Overview:

Police were dispatched to the Wrentham Village Premium Outlets for the report of a past shoplifting.  Upon arrival, police were advised that four male suspects were observed wearing different colored backpacks and currently in the Burberry Store.  Police located the men and temporarily detained them.  Initially, all four men denied shoplifting.  Eventually, one of them admitted to shoplifting four items from the Calvin Klein store.  He voluntarily brought police to his vehicle and turned over the stolen items.  In response, police filed an application for criminal complaint against the man, prompting him to appear for a Clerk-Magistrate’s Hearing in Wrentham District Court.  He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, Inc. to represent him at his hearing.  

Case Result: No Criminal Complaint Issued.

The man was an Indian Citizen in the United States on a visa to attend school.  He was also enrolled in law school.  After the hearing, and the Clerk-Magistrate’s consideration of a mitigation packet prepared and submitted by Attorney Calcagni and his team, the Clerk-Magistrate exercised his discretion to not issue a criminal complaint.  Alternatively, the Clerk-Magistrate elected to hold this matter open for a period of six months.  Providing the man is not charged with a new offense during this time, the application for criminal complaint will be denied, thereby enabling the man to maintain a clean criminal record.
