Criminal Charges:
Man charged in the Plymouth County Hingham District Court for:
- Assault & Battery with a Dangerous Weapon (baseball bat) – M.G.L. c. 265, § 15A (b);
- Assault & Battery – M.G.L. c. 265, § 13A (a)
Case Overview:
Police were dispatched to Jillian’s Sports Pub and Grill for the report of a man striking a customer with a baseball bat and fleeing the scene. Upon arrival, police met with a group of customers in the rear parking lot, some of whom were attacked. One of the customers had a fresh wound on his face and informed police that he was thrown to the ground and punched in the face by his attacker. Another customer informed police that the same man struck his arm with a baseball bat, which was visibly red and swollen. Police interviewed multiple witnesses who corroborated these events. Police obtained the license plate number to the attacker’s vehicle and contacted him by phone. The man admitted his conduct but claimed that he acted in self-defense and the defense of others. The man retained Massachusetts Criminal Defense Attorney, John L. Calcagni III, to represent him in this case.
Case Result: Continuation Without a Finding (CWOF) for 18 Months.
Following ongoing negotiations, Attorney Calcagni and his team successfully secured the Commonwealth’s agreement to continue the matter without a finding (CWOF) for 18 months with the condition the man complete an anger management program. Once before the Court, the judge adopted this agreed upon recommendation and sentenced the man accordingly. This enabled the man to avoid a criminal conviction. The case will be dismissed at the end of the CWOF period provided the man is not charged with a new offense and completes the required program.
