A woman hired the Law Office of John L. Calcagni, III to represent her in the Worcester County; Uxbridge District Court for:

  • Abuse Prevention Order – M.G.L. c. 209A

Case Overview:

A woman retained the MA Law Office of John L. Calcagni III to represent her at an extension hearing related to an abuse prevention order filed against her by her husband, which was previously extended for one (1) year.  The two were married for several years and in the process of undergoing a divorce.  The basis of the original order was related to an alleged assault and battery the woman committed against her husband.  While they were still living together, she found out he was talking to another woman on his phone, and responded by allegedly hitting him with closed fists, slapping him, and scratching his face, neck, and chest.  This is what prompted him to initially apply for the abuse prevention order.  

Case Result: Extension REquest Denied and Abuse Prevention Order Terminated.

One year later, although the two no longer resided together, and the Family and Probate Court had allowed them to communicate electronically and be around each other for purposes of their children, the husband still claimed that he was in fear of his wife and sought extension of the previously imposed abuse order.  Once before the Court and following questioning of the husband and oral arguments by the lawyers, the judge declined his extension request and terminated the restraining order.
