Criminal Charges:
Man charged in the Middlesex County Waltham District Court for:
- Assault with a Dangerous Weapon (to wit: firearm), in violation of M.G.L c. 265, § 15(B)(b)
Case Overview:
Police were dispatched for the report of a man who brandished a firearm during an alleged road rage incident. Upon arrival, police spoke to the complaining witness who informed them while traveling in his vehicle, another vehicle, whose license plate he was able to identify, stopped short in front of him. He then beeped at the vehicle, drove around it, and flipped the man off, at which time he witnessed the man pull out a firearm, placing him in fear. Police identified the man through his license plate, and discovered he owned two firearms and had an active License to Carry (LTC). Police located the man, asked to speak with him, and observed a holstered firearm on his right hip. Officers disarmed him and discovered that the firearm was loaded. The man acknowledged the complaining witness’s version of the events but denied ever brandishing his firearm during the incident. The man was arrested and charged with Assault with a Dangerous Weapon and retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, and his team, to represent him in his case.
Case Result: Dismissed.
Attorney Calcagni and his team immediately drafted, filed, and litigated a motion to dismiss on the man’s behalf. The Court granted the motion and as a result, the case was dismissed.
