Case Overview:
A man pending divorce after twenty years of marriage felt betrayed by his lifelong friends who sided with his spouse. His resulting actions caused police to be dispatched to three separate residences. Upon arrival at the first residence, the reporting party alleged that the day beforehand, the man entered his property and spun his tires out on a newly sealed driveway causing damage. Upon arrival to the second residence, the reporting party alleged that the man spun his tires out on his front lawn causing damage to the grass. Lastly, upon arrival to the third residence, the reporting party alleged that while leaving a gold course, the man intimidated with his vehicle while the two men where on the roadway. Police filed two applications for criminal complaints to issue against the man. The first application alleged he committed the crimes of Negligent Operation of a Motor Vehicle, Vandalizing Property, and Leaving the Scene of Property Damage, and the second alleged Negligent Operation of a Motor Vehicle and Assault with a Dangerous Weapon. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in his cases.
Case Result: Applications for Criminal Complaints Held Open for 3 Months; To Be Dismissed.
Following arguments by Attorney Calcagni and his team, the Clerk-Magistrate decided to hold both matters open for three months. Providing the man remains out of trouble during this period, the applications for criminal complaints will ultimately be denied and no criminal charges will result from these incidents.
