Case Overview:
A couple was pending divorce. The Family Court ordered the wife to vacate the marital home and granted the husband temporary physical custody of their children. She called police and alleged the husband assaulted her during a child exchange. When the police arrived, the woman had already left the residence. The husband informed them his wife entered the marital residence without permission and against the Family Court Order. He asked her to leave multiple times, but she refused. The husband further informed police that during this encounter, the wife invaded his personal space, and that he responded by lightly pushing her away. The husband also showed the police video footage of the event that he captured on his phone. Police interviewed the woman at the station who reported that during the argument, her soon-to-be ex-husband grabbed her by her wrists and pushed her. She also showed the police a video she made on her phone. Following the investigation, police determined the woman was the aggressor and charged her with Assault on a Family / Household Member in Fall River District Court. She retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent her in this matter.
Case Result: Case Dismissed.
After reviewing and analyzing all the evidence, Attorney Calcagni successfully persuaded prosecutors to dismiss the case against his client.
