Case Overview:
A woman, who had an active restraining order against her ex-boyfriend in Connecticut which ordered him to have no contact with her, walked into the Boston Police Station to report a violation of the restraining order. She informed police he had been stalking her via Facebook and other social media sources. At the direction of law enforcement, the woman applied for and was granted a second restraining order against her ex-boyfriend in Massachusetts. The next day, she went back to the station and informed police that he was continuing to post messages on Facebook, in violation of the restraining order. Boston Police then filed an application for criminal complaint against the ex-boyfriend alleging Violation of an Abuse Prevention Order. He retained Massachusetts Criminal Defense Attorney, John L. Calcagni III, to defend him in this case.
Case Result: Application for Criminal Complaint Denied.
After reviewing the documentation filed in support of the application for criminal complaint, conducting investigatory efforts on the man’s behalf, and obtaining documentation in support of the ex-boyfriend’s defense, Attorney Calcagni appeared with the man for his Clerk-Magistrate’s Hearing. Following oral argument by Attorney Calcagni, his submission of various materials obtained during his investigation, and his discussions with the Clerk-Magistrate and Police Prosecutor, Attorney Calcagni successfully secured the Clerk Magistrate’s agreement to deny the application for criminal complaint.
