Charged with Possession to Distribute Marijuana in Webster, MA
Criminal Charges:
A man was arrested in Webster, Massachusett and charged in Worcester County in the Dudley District Court for:
- Possession to Distribute a Class D Drug in violation of M.G.L. c. 94C, § 32C (a);
- Unlicensed Operation of a Motor Vehicle in violation of M.G.L. c. 90 § 10; and
- Failure to Signal in violation of M.G.L. c. 90 § 14
Case Overview:
MA State Police were dispatched to a disabled motor vehicle on I-395 South in the Town of Webster. A state trooper approached the driver and asked him for his license. The driver informed the trooper that he did not have a license but had possessed one before. The driver provided the trooper with his name and date of birth. The trooper used this information to research the driver and discovered that he had an extensive negative driving history and an active warrant for his arrest in Dudley District Court for Unlicensed Operation of a Motor Vehicle in violation of M.G.L. c. 90, § 10 and Failure to Signal in violation of M.G.L. c. 90, § 14. The trooper placed the driver under arrest and during an inventory search of his vehicle, discovered 100 loose baggies, one scale, four glass jars containing marijuana, and four large plastic bags containing marijuana, totaling approximately 34 ounces of the substance. Based on this discovery, the driver was charged with Possession to Distribute a Class D Drug (to wit: marijuana) in violation of M.G.L. c. 94C, § 32C (a), and again, with Unlicensed Operation of a Motor Vehicle in violation of M.G.L. c. 90, § 10. The man retained Massachusetts Attorney John L. Calcagni III and his team to work on his case.
Case Result:
Following ongoing negotiations with the District Attorney’s Office, Calcagni’s team successfully secured the prosecution’s agreement to dismiss all driving offenses and to continue the marijuana charge without a finding for a period of 6 months with no conditions. Providing the man is not charged with a new offense during this period, this charge will also be dismissed.
