Case Overview:
Police were dispatched to a Dunkin’ Donuts for the report of an employee involved in an altercation with a customer. Upon arrival, police spoke to the employee who informed them that after a customer’s credit card was declined multiple times, she asks the customer to return the food items. Later the employee then went out to her car and discovered the customer was present and blocking in her car. The customer berated the employee for perceived, poor customer service and assaulted her. Police reviewed surveillance footage of the incident and interviewed witnesses, to who confirmed the incident. As a result, the customer was charged in Fall River District Court with Assault and Battery. After refusing to plead guilty and experiencing dissatisfaction for her first lawyer, she smartly retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend her in this matter.
Case Result: 9 Months Pretrial Probation.
After reviewing and analyzing the evidence, and following ongoing negotiations with the Commonwealth, Attorney Calcagni and his team secured the Commonwealth’s agreement to place the customer on pretrial probation for a period of 9 months, which is considered a prolonged dismissal opposed to a criminal conviction. Pretrial probation does not even require an admission of guilt or acceptance of criminal responsibility. Providing the man remains out of trouble for this 9-month period, his case will automatically be dismissed, and come eligible to seal it from his Massachusetts criminal record.
