Case Overview
A man contacted his insurance company to report that his vehicle was damaged when it was hit by another vehicle while parked outside of his home in New Bedford, Massachusetts. The insurance company’s appraiser looked at the vehicle and estimated the damage at approximately $2,500.00. However, the appraiser did not believe it was related to vehicle-to-vehicle contact. The insurance company’s forensic reconstructionist examined the damaged vehicle and determined the front-end damage was not from vehicle-to-vehicle contact but rather the vehicle coming in contact with a coarse fixed object while in motion. When questioned by the Insurance Fraud Bureau’s investigator, the man maintained his story, and his insurance claim was denied. The Insurance Fraud Bureau then filed an application for criminal complaint against the man in New Bedford District Court alleging the man committed the crimes of Fraudulent Motor Vehicle Insurance Claim and Misdemeanor Attempt to Commit a Crime. The man received a summons in the mail to appear for a Clerk-Magistrate’s Hearing and retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him at his hearing. After hearing, the application for criminal complaint was denied.
