Case Overview
Police were dispatched to a residence for the report of a domestic disturbance. Upon arrival, they met with a woman, who informed them that she and her boyfriend had an argument that escalated. The initial argument prompted the boyfriend to sleep on the couch. After approximately 15 minutes, the argument resumed and boyfriend became irate. He got up, and flipped the couch, coffee table, and TV onto the floor, breaking a lamp and causing other damage. He then got into his truck and backed into the woman’s car, totaling it. The woman called police. The boyfriend received a summons in the mail to appear for arraignment in Taunton District Court. He retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in this case. After securing the man’s release on personal recognizance bail, reviewing and analyzing all the evidence, and ongoing negotiations with the Commonwealth, Attorney Calcagni and his team persuaded the prosecution to resolve this case with pretrial probation. This form of pretrial disposition is essentially a prolonged dismissal of the case that is not a conviction and requires no admission of guilt of criminal responsibility. Providing the man does not abuse the woman for a 9-month period and stays out of trouble during this time, his case will be dismissed, and become immediately eligible to be sealed from public record.
