City, State, County and Court:
Seekonk, Massachusetts, Bristol County
Taunton District Court
Case Overview:
Police observed a white 2015 Infiniti Q70 operating on the highway in moderate traffic traveling 120 mph in a 65-mph zone. The vehicle was also following others too closely and activating its high beam lights to force other vehicles to change lanes. When some vehicles did not change lanes, the Infiniti made unsafe lane changes, placing other motorists at risk. Police stopped the vehicle and charged the motorist in Taunton District Court with Negligent Operation of a Motor Vehicle and Speeding. After his arraignment, the man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him.
Case Result: Pretrial Probation.
After several pretrial conferences, Attorney Calcagni successfully persuaded prosecutors to place the man on pretrial probation for six months. This form of disposition is essentially a prolonged dismissal, which requires no admission of guilt and does not result in a criminal conviction. The Court adopted the parties’ joint recommendation. In six months, providing the man remains out of trouble, the case will be dismissed, and be immediately eligible to be sealed from his Massachusetts criminal record.
