Case Overview
The police were dispatched to a Target in Dartmouth, Massachusetts for shoplifting. Upon arrival, they met with a loss prevention officer and the male party who had allegedly shoplifted in the presence of his juvenile daughter. While attempting to leave the store, the man was stopped by a loss prevention officer and escorted to the loss prevention office. The police asked the man to step out of the office so they could speak with him outside the presence of his daughter. The man waived his Miranda rights, and admitted to tampering with price tags to illegally reduce the cost of the items he sought to obtain from the store. There was also video surveillance of his misconduct. The man received a no trespass order from Target and Dartmouth Police filed an application for criminal complaint against him alleging he committed the crime of Shoplifting by Price Tag Tampering. He received a summons to appear for a Clerk-Magistrate’s Hearing in New Bedford District Court. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him. After hearing, the Clerk-Magistrate denied the application for criminal complaint, resulting in no criminal charges.
