Criminal Charges:
Man summoned at the Plymouth County Brockton District Court for speeding rate of speed exceeding posted limit in violation of M.G.L. c. 90, § 17
Case Overview:
A man with an extensive negative driving history was summonsed to appear for a Clerk-Magistrate’s Hearing in Brockton District Court. He was cited by Massachusetts State Police Department for speeding 88 mph in a 65-mph zone. The man had multiple speeding violations on his driving record, in multiple jurisdictions, within a very short period of time. As such, he feared that if he was found responsible for another speeding violation, the Massachusetts Registry of Motor Vehicles (RMV) would suspend his license.
The man contacted and retained the Law Office of John L. Calcagni III, Inc. to represent him at the hearing related to this most recent citation. In preparation for this event, Attorney Calcagni reviewed in detail the facts and circumstances surrounding the man’s case and directed him to enter and complete a 6-hour defensive driving course. A certificate of completion from the course was offered by the Defense as an exhibit at the hearing. Following oral argument at the hearing, the Clerk-Magistrate agreed to hold the matter open for six months, and assuming the man incurred no further driving infractions during that time, he would be found not responsible this around and the speeding citation would be dismissed. This result enabled the man to successfully avoid a license suspension.
Case Result:
Dismissed / Not Responsible.
