Man indicted in Bristol County Superior Court, Attleboro, Massachusetts for:
- Trafficking in 100-2,000 Pounds of Marijuana, in violation of M.G.L c. 94C, § 32E(a)(2)
- Conspiracy to Violate Drug Law, in violation of M.G.L. c. 94C, § 40
Case Overview:
Police commenced an investigation into an illegal marijuana grow being operated in Attleboro, Massachusetts. As a result of surveillance and other investigative techniques, police were able to identify two men who were growing a high volume of marijuana plants. The investigation led to the issuance of a search warrant which yielded a complex, sophisticated grow operation to include, chemicals, fertilizers, fans, filtration systems, irrigation systems, artificial lighting, reflective mirror boards, hydroponic grow containers, and numerous marijuana plants. Both men involved were arrested, indicted in Bristol County Superior Court, and charged with Trafficking in 100-2,000 Pounds of Marijuana, which is a felony that carries a mandatory minimum 2-year state prison sentence, and Conspiracy to Violate Drug Law. One man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in his case.
Case Result: Drug Trafficking Amended to Possession to Distribute Marijuana with 2-Year Probation.
After reviewing all the evidence, litigating several motions, and negotiating with the Commonwealth, Attorney Calcagni successfully persuaded the Commonwealth to amend or reduce the more serious felony trafficking charge to the less serious misdemeanor charge of Possession to Distribute a Class D Drug (marijuana), which calls for no mandatory jail. In exchange for the man’s admission to this reduced offense, he was placed on probation for two years.
