Criminal Charges:
A man charged in Fall River, Massachusetts, Bristol County Fall River District Court for:
- Assault and Battery on a Family/Household Member, in violation of M.G.L. c. 265, § 13M(a)
- Threat to Commit a Crime, in violation of M.G.L. c. 272, § 2
Case Overview:
Police responded to a residence for the report of an argument between a woman and her ex-boyfriend, who had just left the property. When police arrived, the girlfriend informed police that she no longer wished to be in a dating relationship with the man, had broken up with him two weeks earlier, and that they have been arguing ever since. She further informed police that her ex-boyfriend claimed he recently received his firearms license and threatened to shoot any other men she chose to date. The woman further alleged that one of their arguments a week earlier turned physical when the man allegedly shoved her. Based solely on the woman’s uncorroborated claims, the man was criminally charged with Assault and Battery on a Family/Household Member and Threat to Commit a Crime in Fall River District Court. A warrant was issued for his arrest and remained outstanding for several months. After learning of the warrant and surrendering himself to the Court, the ex-boyfriend retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him against these domestic violence criminal charges.
Case Result: Dismissed.
After reviewing and analyzing all the evidence, and appearing for several pretrial conferences, Attorney Calcagni and his team successfully persuaded the prosecution to dismiss both charges against the client.
