Case Overview:
Police were dispatched to a residence for the report of a domestic disturbance between a man and a woman who were in a previous dating relationship and had a child in common. Police spoke to the woman who informed them that she went to the man’s residence to check on his well-being due to suicidal texts and statements he had made to her. The two then began to have a conversation inside of her car in his driveway, which the woman had partially recorded. The woman further informed police the man had previously assaulted her in the past, and on this particular occasion, following a verbal argument, broke the interior door handle off of the passenger side door, lunged at her, tried to grab her phone, grabbed her by the arms, and began to man-handle her inside of the vehicle. The man eventually exited the vehicle, and the woman called the police. Police also spoke to the man, but he denied anything physical had occurred. Police placed the man under arrest and charged him with Assault and Battery on a Family / Household Member. He retained the Law Office of John L. Calcagni III, Inc. to represent him in his case in New Bedford District Court.
Case Result: 6 Months Pretrial Probation.
After reviewing and analyzing all the evidence, conducting investigatory efforts on the man’s behalf, and ongoing negotiations, the Commonwealth agreed to place the man on pretrial probation for 6 months, which is considered a prolonged dismissal opposed to a criminal conviction. Pretrial probation does not even require an admission of guilt or acceptance of criminal responsibility. Providing the man remains out of trouble for this 6-month period, his case will automatically be dismissed, and come eligible to seal it from his Massachusetts criminal record.
