Case Overview:

Police received a 911 call from a woman who stated her soon-to-be ex-husband pushed her to the ground.  When police arrived at their residence, she further informed officers that they had a verbal argument that became physical.  Initially, he swiped his arm across his work desk, knocking all its contents to the floor.  As the argument progressed, he placed his cell phone on the kitchen counter and began to record her without her consent.  She then took his cell phone and proceeded into the living room.  When he attempted to get it back, he knocked her to the floor.  The man admitted to police what had occurred.  He was charged with Assault and Battery on a Family / Household Member in Uxbridge District Court and retained Massachusetts Criminal Defense Attorney, John L. Case Result: Six Months Pretrial Probation.

After obtaining and reviewing all the evidence in the case and conducting legal research in support of the man’s defense of property claim at trial, Attorney Calcagni and his team engaged the Commonwealth in pretrial negotiations.  The prosecution agreed to place the man on pretrial probation, which requires no admission, for six months.  After careful thought and consideration, the man decided to accept this offer.  In six months, assuming he is not charged with a new offense, the case will be dismissed and become immediately eligible to be sealed from public record.
