Charges filed by Fall River Police for Heroin Trafficking and Firearms Offenses.
Case Overview:
In October 2018, a woman reported to Fall River Police that her boyfriend assaulted her. She also told police the man had a gun at her apartment, and that she feared for her life. Police obtained a search warrant for the residence and located a small black nylon bag containing four double stack high capacity pistol magazines loaded with ammunition alongside a photo ID with the man’s name on it. Police also found six bags of heroin with a combined weight of over one kilogram. Unable to locate the man, police issued a warrant for his arrest, alleging Assault and Battery on a Household Member; Assault and Battery on a Pregnant Victim; Trafficking in Heroin; Possession of Ammunition without an FID Card; Possession of a Large Capacity Weapon; and, Possession of a Firearm in a Felony. In 2020, the man returned from Puerto Rico to self-surrender on the warrant and face prosecution. He hired Massachusetts Drug Trafficking Defense Lawyer, John L. Calcagni III, to represent him in this matter.
Case Result:
Bail granted. Once before the Court, the prosecution moved to hold the man without bail on grounds of dangerousness. Attorney John L. Calcagni III demanded an immediate bail hearing the following day and successfully defeated the Commonwealth’s request. Following oral argument by Attorney John L. Calcagni III, the Court set bail in the amount of $10,000 cash with the conditions that the man be subject to home confinement, GPS monitoring and have no contact with the alleged victims (his ex-girlfriend).
