Criminal Charges:
Man charged with various Motor Vehicle charges in the Wrentham District Court, Norfolk County, Massachusetts for:
- Failure to Stop for Police, in violation of M.G.L. c. 90, § 25
- Operating Motor Vehicle, License Suspended (Subsequent Offense), in violation of M.G.L. c. 90, § 23
- Negligent Operation of a Motor Vehicle, in violation of M.G.L. c. 90, § 24(2)(a)
- Speeding, in violation of M.G.L. c. 90, § 18
Case Overview:
A man with a bad driving record and an open Norfolk County Superior Court criminal case for drug trafficking and multiple assault charges for running down and trying to flee from multiple police officers who were attempting to execute a warrant for his arrest, was charged criminally with running from police again. This time he was charged in the Wrentham District Court with Failure to Stop for Police, Operating Motor Vehicle while License Suspended (Subsequent Offense), Negligent Operation of a Motor Vehicle, and Speeding. Police observed the man’s vehicle travelling 72 MPH in a 55 MPH zone. In response, they executed a traffic stop. As the officer approached the man’s stopped vehicle on the roadway, he could see the man again reaching toward the center console and looking in the rear-view mirror. When the officer asked to see the driver’s hands, the man sped away erratically. A chase ensued, and police lost sight of the vehicle. Later that day, police located the vehicle parked with the man sleeping in it. Unsurprisingly, he was arrested and charged with the above-referenced offenses. The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in this case and the ensuing bail violation filed in the Superior Court.
Case Result: One (1) Year Continuation Without a Finding.
Attorney Calcagni and his team secured the man’s continued release on bail, over the prosecution’s objection. After pretrial negotiations, Attorney Calcagni and team persuaded the prosecution to dismiss the Failure to Stop for Police and Operating Motor Vehicle with License Suspended (Subsequent Offense) charges, which call for mandatory minimum time and continue the Negligent Operation of a Motor Vehicle charge without a finding (CWOF) for one year.
