Cocaine Trafficking in Worcester County MA: Successful Case Amendment

Case Overview:

Police initiated a traffic stop after observing a vehicle speeding and committing several marked lanes violations. While initiating the stop, police observed the occupant try to hide an object in the back seat. Once stopped, police confirmed that the man did not have a valid driver’s license. During an inventory search of the vehicle, prior to having it towed away, police located one kilogram of cocaine. As a result, the man was charged with Operating a Motor Vehicle with a Suspended License and Trafficking in Cocaine (200+ Grams), which carries a mandatory minimum 12-year day-to-day state prison sentence. While out on bail, the man was rearrested and charged in New York with multiple drug trafficking charges for his involvement with the transportation of approximately thirty kilograms of cocaine in children’s lunchboxes from the Dominican Republic and Puerto Rico to New York. He resolved his case in New York with a five-year prison sentence. Once transported back to Massachusetts, Attorney Calcagni secured the prosecutor’s agreement to amend the trafficking charge to Trafficking in Cocaine (36-100 Grams), which only carries a mandatory minimum 3 ½ year day-to-day state prison sentence. In exchange for the man’s guilty plea to this lesser charge, the man received a sentence of 5 to 7 years in state prison, to run concurrently with his New York sentence.
