Defense Secures Bail for Man Facing Rape in Quincy MA

Case Overview:

Police received a 911 call hang-up, seeking assistance. Unable to reach the caller, Quincy Police Dispatch sent patrol officers to the caller’s location, using GPS tracking from the cellphone used to make the call. Upon arrival, they were met with a man and woman. The woman alleged that the man had picked her up a day or two earlier and that she had been staying at this home. The two had known each other since high school. They are both alcoholics. The woman admitted to alcohol consumption and consensual sex with the man. However, she awoke that day from a sound sleep to find the man penetrating her vagina with a sex toy, and filming the act, which he was allegedly streaming on the internet, all without her consent. When she confronted the man, he allegedly punched her in the head. The man was fully cooperative with police. He waived his rights, gave a statement denying the allegations, and consented to a search of his cellphone, which contained recordings that contradicted the woman’s claims. Notwithstanding, the man was arrested and charged with Rape, Photographing a Sexual Partner Without Consent, and Assault and Battery. This was the man’s second rape case within one year, the first case having been dismissed three months earlier. In response to these new and similar charges, the man’s father immediately retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in this case.

Case Result: Bail Granted.

After conducting investigatory efforts on the man’s behalf and preparing a bail package for the Court’s consideration, Attorney Calcagni defeated the prosecution’s motion to hold his client in pretrial detention based on dangerousness. The Court granted Attorney Calcagni’s request to release the man on $20,000 cash bail, electronic monitoring, and no contact with the complaining witness.
