Man charged in the Plymouth County Wareham District Court for:
- Unlicensed Operation of a Motor Vehicle in violation of M.G.L. c. 90, § 10
- Unregistered Motor Vehicle in violation of M.G.L. c. 90, § 9
- Uninsured Motor Vehicle in violation of M.G.L. c. 90, § 34
- Marked Lanes Violation in violation of M.G.L. c. 89, § 4
Case Overview:
Police were dispatched to a crash involving a motorcycle and motor vehicle. Upon arrival, police observed a minivan with significant damage. Off to the side of the roadway was a motorcycle with heavy damage and no license plate attached to it. The operator of the motorcycle had minor injuries. The driver of the minivan was unharmed and told police that the motorcyclist was traveling at a high rate of speed, crossed over the yellow line and struck his vehicle. A police query of the motorcyclist revealed he did not have a license and that the motorcycle was both unregistered and uninsured. Police cited him for Unlicensed Operation of a Motor Vehicle, Operation of an Unregistered Motor Vehicle, Uninsured Motor Vehicle, and Marked Lanes Violation.
Case Result: Applications for Criminal Complaint Denied
The operator retained Massachusetts Motor Vehicle Defense Lawyer, John L. Calcagni III, and exercised his right to a Clerk-Magistrate’s Hearing in Wareham District Court. Following oral argument by defense counsel, the application for criminal complaint was denied enabling the motorcyclist to avoid criminal charges and any potential adverse consequences to his military career.
