Case Overview:

Police were dispatched to a residence for the report of a domestic altercation involving an intoxicated man with a firearm who fled on foot.  Upon arrival, police spoke to the man’s girlfriend who informed them a verbal argument ensued between her and her boyfriend, he started throwing things around the apartment, grabbed and threw a vase of flowers containing water at her, and then pushed her, which resulted in her slipping on the water, falling to the floor, and injuring her knee.  She also informed police he displayed a firearm during the argument, and has a history of getting drunk and high in the past and getting aggressive with her.  Police located the man, and although unable to locate the firearm, placed him under arrest for Assault and Battery on a Family / Household Member.  The man retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to defend him in New Bedford District Court.  

Case Result: Six (6) Months Pretrial Probation

After obtaining, reviewing, and analyzing the evidence, and following pretrial negotiations with the Bristol County District Attorney’s Office, Attorney Calcagni successfully secured the Commonwealth’s agreement to place the man on pretrial probation, which requires no admission of guilt or criminal responsibility or guilt, for a period of six (6) months, with the conditions that he have no contact with the alleged victim, abide by the restraining order in place between them, and undergo a mental health evaluation.  Once this six (6) month period expires, assuming the man remains out of trouble complies with the imposed conditions, this case will be dismissed.
