Case Overview:
A woman walked into the Fall River Police Station to report being physically assaulted by her long-term boyfriend. She informed police while they were on their drive home from the beach, she confronted him about maintaining a single status on his Facebook account and why a former girlfriend was not blocked on his social media. An argument ensued, during which time the woman alleged that the man screamed at her, clenching his fists, got in her face, calling her names, and said he wanted to strangle and punch her in the face. The woman stated the boyfriend then pulled the car over, threw her water bottle out the window, and told her to get out. When she refused to, he grabbed and swatted at her face. The boyfriend then continued driving while the argument escalated. They eventually reached their destination and parted ways. The next day, the woman said she woke up to her wrist being in pain and swollen from a bad sprain. Based on this information, police contacted the boyfriend, who voluntarily went to the police station, told his version of the events, and was arrested and charged in Fall River District Court with Assault and Battery on a Family / Household Member and Witness Intimidation. The boyfriend retained Massachusetts Criminal Defense Lawyer, John L. Calcagni III, to represent him in this case.
Case Result: Case Dismissed.
After reviewing and analyzing all the evidence, Attorney Calcagni successfully secured the dismissal of both charges, making the case immediately eligible to be sealed in Massachusetts.
